Rent Distress
When a tenant goes into rent arrears the Landlord has the common law right to distrain for the amount owing.
Rent Bailiffs are professional Certificated bailiffs with many years of experience in resolving unpaid rent issues and maintaining the Landlord Tenant relationship, we are backed up by office staff who are fully conversant in the Laws of distress and the regulations that the bailiffs have to adhere to.
Once instruction has been received from our client we endeavour to undertake the distraint on the same day, this of course is dependent on the time we receive instruction as the Law only allows the distraint to be levied between Sunrise and Sunset.
When the bailiff attends, he/she will discuss with the tenant the reason for the bailiffs attendance, the bailiff will then levy the distress* and negotiate payment.
In most cases the rent arrears and our costs are paid in full within hours of our bailiffs attendance or a walking possession agreement is signed, giving the tenant time to pay - the Landlords interests secured on the goods siezed and impounded.
Occasionally it is necessary for the distress to involve removing the goods levied, this will incur the tenant in costs for transport and associated charges & fees.
Any goods removed will be taken to a secure pound and arrangements will be made for them to be sold after 5 days.
* Rent Bailiffs will ensure that all goods siezed are itemised in the inventory and that photographs are taken. The reason we do this is to ensure that the distraint is correct in every way, therefore no question can be raised concerning our actions and the goods siezed.
Many bailiff companies adopt a 'blanket distraint' process whereby distrained goods are bulked together and there is no full inventory.
When this happens, especially when liquidators are involved or other bailiffs attend to distrain, the blanket distraint cannot stand up to any query, whereas our full itemised distraint will stand up to any indepth questioning and scrutiny.
